General conditions applicable to reservation of tickets/seats via the Internet

Art.1 These General Conditions regulate the use of the website www.gentjazz.com and are applicable to any offer or agreement concerning products or services sold by Gent Jazz. A deviation therefrom can only be agreed upon in writing. Even in case of such written deviation, these General Terms and Conditions will at least keep their supplementary effect for all aspects that have not been explicitly settled in writing.

Gent Jazz reserves the right to modify these conditions if necessary and therefore recommends you to regularly check these conditions on the website for any changes. Of course, any change will not affect the product or service purchased by you.
These general terms and conditions should also be read together with i) the visitors’ regulations (insert link) (which contains the agreements applicable on the festival site and which you accept by purchasing a ticket) and ii) the special ticket conditions.

Art.2 The website allows the customer to reserve one or more seats of a certain category for a period determined by Gent Jazz, or until the available quantity is exhausted.

Art.3 All offers and quotations by Gent Jazz, in whatever form they are made, are without obligation unless a period for acceptance is included in the offer. The products as offered in the web shop are available while supplies last.

Are you a consumer? Then you have the right to revoke your order within a period of 14 days, without giving reasons, in accordance with the instructions that can be consulted on the website of the FPS Economy. As a consumer, you may use the model withdrawal form made available to you via the link. The use of this form is not obligatory. Your cooling-off period will start the day after you receive the confirmation of your order. The consumer shall bear the costs for any return shipment of the products. The right of withdrawal is not open to professional customers.

Art.4 Gent Jazz is committed to the prevention of all possible forms of misrepresentation, deception and fraud, as well as any discrimination in relation to access to and use of the Website. With this in mind, it disclaims any responsibility if the customer fails to make payment, or provides false information at the time of reservation of one or more places. This is an obligation of means. Gent Jazz is not and will not be liable in any way for the fact that certain players manage to get hold of tickets of Gent Jazz without the agreement of Gent Jazz and then resell those tickets at a higher price. The only way to legally obtain a concert ticket is through www.gentjazz.com.

Art.5 The price mentioned on the website at the time of final payment is determined and payable in Euros and includes VAT and other governmental levies, unless explicitly stated otherwise. The customer must transfer this price to Gent Jazz via the possibilities offered during the online ordering process,
The customer is in any case and solely responsible for the correct and complete execution of the payment and all other data related to this purchase, such as the communication of an email address for sending the tickets.

Art.6 Within 7 (seven) working days following receipt of payment at the latest, the customer shall receive the tickets via a link sent to the e-mail address provided by the customer. The customer is expected to print these tickets and keep them with due care. Upon request, he must present them at the event to gain access to the festival.

Art 7. Tickets will not be refunded under any circumstances, including in case of cancellation and/or force majeure or loss.  If Gent Jazz cannot execute the delivery and/or execution in whole or in part, not in time or not properly, or has to cancel at any time due to one or more reasons of force majeure, then this (whole or partial) non-fulfilment, untimely fulfilment or not proper fulfilment cannot be attributed to it. Gent Jazz shall not be liable if a failure is the result of force majeure. She will in no case be liable for any compensation to the customer.

During the period of force majeure, obligations of Gent Jazz will be at least temporarily suspended. If the fact of force majeure lasts longer than one month, both parties will be entitled to terminate the agreement without judicial intervention, without any obligation to pay damages.
The term 'force majeure’ is understood to mean in any case, unforeseen circumstances, also of an economic nature, which have arisen through no fault of the company, such as, among others, a serious disruption in the company, forced reduction of production, unforeseen shortcomings, fire, strikes and lockouts, both at the company and at suppliers, pandemic, epidemic, governmental order or governmental measure, travel ban, war, hostilities, terrorist attacks or threat thereof, state of siege, mobilisation, weather conditions that seriously hinder the execution of the agreement, either in Belgium or in any other country where suppliers or booked artists are located.

Gent Jazz tries to offer a nice and qualitative line-up for every festival day. These artists are contacted and booked well in advance of the festival. Nevertheless life remains unpredictable and there can be reasons why an artist unfortunately cannot perform on the planned day. Such changes in the programme are always possible and cannot give rise to a refund or compensation.

Art.8. The special ticket conditions will be stated on each ticket and read as follows:
This ticket, subject to compliance with the visitors’ regulations and the instructions of the festival staff, grants access to the Gent Jazz Festival site to one person only, on the date indicated on the front of this ticket and for all performances taking place on that day. This ticket must be shown, together with the visitor’s ID, at any request by Gent Jazz or its staff and engaged security personnel. If the visitor does not comply with the visitor’s regulations or instructions, he/she may be denied further access to the festival site. On the festival site, you can make your purchases via our jazztons. The holder participates at his/her own risk in the event to which this ticket gives access and releases the organisation and operator from any liability in case of incidents and/or accidents. On entering the festival site, the visitor authorises the organisation to make visual images for publication purposes. It is forbidden to photograph, make sound or video recordings. Animals are not allowed, except for guide dogs. In case of falsification of entry tickets or other festival receipts, criminal charges will be filed. All personal data collected when purchasing this ticket is in accordance with the European General Data Protection Regulation (GDPR), effective from 25 May 2018. The ticket is only valid with a legible barcode or control strip. This ticket will not be taken back, exchanged or refunded under any circumstances.

Art.9 By reserving places via the website and the data that the customer transmits to the manager and the organisation in doing so, these may be used by the manager or the organisation for the sole purpose of informing the customer of new events. The customer may at any time waive this benefit upon simple request and/or view and, if desired, correct his data. The organisation does not sell personal information. The organisation does not share personal information with third parties.
Gent Jazz complies with its obligations as they arise from applicable data protection regulations, including but not limited to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("AVG”) and national implementing legislation. Art.10 If any of the General Terms and Conditions should prove to be null and void or partially unenforceable, the remaining General Terms and Conditions shall not be affected thereby and shall retain their full effect minus the disputed clauses to the extent possible. The parties undertake to negotiate in good faith a new clause that will include the intention of the invalid clause, if any.

Art.11 Any complaints should be sent by registered mail to the address of the organisation mentioned in Art. 13 within 3 (three) days after the establishment of the fact that is the subject of the complaint, and should be fully justified and accompanied by all necessary supporting documents. Failing this, gent Jazz reserves the right not to handle the complaint.

Art.12 In case of a dispute, only the courts of Gent have jurisdiction, with a procedure in the Dutch language and only Belgian law is applicable, to the exclusion of the Vienna Sales Convention.
